The Employment Rights Act introduces new obligations that could significantly increase operational costs and legal risks. Key changes include:

1. First day Statutory Sick Pay

With SSP available from day one and lower earnings limits removed, employee absences, and employer costs, are expected to rise sharply.

2. Day one Bereavement Leave

1 in 4 workers experienced a bereavement in 2025. Individuals will soon have the right to one week of unpaid leave, which could further increase absence levels and impact workforce capacity.

3. Sexual Harassment Prevention Duties

Harassment reports grew by 39% in 2025. Organisations must now demonstrate reasonable steps to prevent sexual harassment and ensure all disclosures are handled safely and fairly.

4. Mandatory Menopause Action Plans

Unmanaged menopause symptoms cost UK employers £200m annually. Larger organisations (250+ employees) must introduce formal action plans, though smaller organisations are encouraged to adopt them too.
